Summary
Law No. 4808/2021 sets out provisions governing labour regulation in Greece. The law also contains articles concerning digital platform work, including a definition of “digital platforms” and provisions regulating the contractual arrangements and obligations relating to occupational safety, health, and collective rights of persons providing services through such platforms.

Article 72. Υποχρέωση ενημέρωσης παρόχων υπηρεσιών για τα δικαιώματά τους Πριν από την έναρξη της παροχής των υπηρεσιών, οι ψηφιακές πλατφόρμες οφείλουν να παραδίδουν στους παρόχους των υπηρεσιών, που συνδέονται μαζί τους με συμβάσεις ανεξάρτητων υπηρεσιών ή έργου, σε ψηφιακή ή έγγραφη μορφή, καθώς και μέσω διαδικτύου, αντίγραφο της μεταξύ τους σύμβασης, η οποία περιέχει, ιδίως, αναφορά στα χαρακτηριστικά των υπηρεσιών που πρόκειται να παράσχουν, τα δικαιώματα συλλογικής οργάνωσης και τις υποχρεώσεις της πλατφόρμας για την υγιεινή και ασφάλεια των παρόχων που προβλέπονται στη νομοθεσία. Article 69. Contractual relationship between digital platforms and service providers 1. Digital platforms shall be linked to service providers by means of employment contracts or independent service or project contracts. 2. The contract between a digital platform and a service provider shall be presumed not to be an employment contract if the service provider is entitled, under its contract, to a cumulative right to (...)
Article 72. Obligation to inform service providers of their rights prior to the start of the provision of services, digital platforms must provide service providers linked to them by independent service or work contracts with a copy of the contract between them, in digital or written form and on the Internet, containing, in particular, an indication of the characteristics of the services they are to provide, their rights of collective organisation and the platform's obligations regarding the health and safety of service providers laid down by law. The contract shall, in addition, include the measures for the protection of the personal data of the service providers which the digital platform receives.

Article 72. Article 71. Health and safety of service providers: 1. Digital platforms have towards the service providers, who are natural persons and are linked to them by independent service or work contracts, the same welfare, hygiene and safety obligations that they would have towards them if they were linked to them by dependent labor contracts, with the relevant legislation applied proportionally.
Article 72. Obligation to inform service providers of their rights. Prior to the start of the provision of services, digital platforms must provide service providers linked to them by independent service or work contracts with a copy of the contract between them, in digital or written form and on the Internet, containing, in particular, an indication of the characteristics of the services they are to provide, their rights of collective organisation and the platform's obligations regarding the health and safety of service providers laid down by law. The contract shall also include the measures for the protection of the personal data of service providers received by the digital platform.

Article 66. Προστασία από τις απολύσεις 1. Η καταγγελία της σύμβασης εξαρτημένης εργασίας αορίστου χρόνου από τον εργοδότη είναι άκυρη, εφόσον:
α) Οφείλεται σε δυσμενή διάκριση σε βάρος του εργαζομένου ή εκδικητικότητα λόγω φύλου, φυλής, χρώματος, πολιτικών φρονημάτων, θρησκευτικών ή φιλοσοφικών πεποιθήσεων, γενεαλογικών καταβολών, εθνικής ή εθνοτικής καταγωγής, γενετήσιου ή σεξουαλικού προσανατολισμού, ηλικίας, ταυτότητας ή χαρακτηριστικών φύλου, αναπηρίας, ή συμμετοχής ή μη σε συνδικαλιστική οργάνωση, ή
β) γίνεται ως αντίδραση σε ενάσκηση νομίμου δικαιώματος του εργαζομένου ή γ) αντίκειται σε άλλη ειδική διάταξη νόμου, ιδίως, όταν πρόκειται για απόλυση: γα) που οφείλεται σε διάκριση για έναν από τους λόγους που προβλέπονται στο άρθρο 1 του ν. 4443/2016 (Α’ 232) ως αντίμετρο σε καταγγελία ή αίτημα παροχής έννομης προστασίας, για τη διασφάλιση τήρησης της αρχής της ίσης μεταχείρισης, σύμφωνα με το άρθρο 10 του ν. 4443/2016, γβ) που οφείλεται στην άσκηση των δικαιωμάτων σε περίπτωση βίας και παρενόχλησης, σύμφωνα με το άρθρο 13, γγ) των εγκύων και τεκουσών γυναικών, όπως και του πατέρα του νεογεννηθέντος τέκνου για το χρονικό διάστημα που ορίζεται στο άρθρο 15 του ν. 1483/1984 (Α’ 153), όταν δεν συντρέχει σπουδαίος λόγος (...)

Article 66. The termination of an indefinite-term employment contract by the employer is invalid if:
a) It is due to adverse discrimination against the employee or retaliatory actions based on gender, race, colour, political beliefs, religious or philosophical beliefs, ancestry, national or ethnic origin, sexual orientation, age, gender identity or characteristics, disability, or participation (or lack thereof) in a trade union.
b) It is carried out in response to the lawful exercise of the employee’s rights. c) It contradicts another specific legal provision, particularly when the dismissal: Is based on discrimination for any reason specified in Article 1 of Law 4443/2016 (A’ 232) as a retaliatory measure against a complaint or a request for legal protection to ensure compliance with the principle of equal treatment, under Article 10 of Law 4443/2016. Is due to the exercise of rights in cases of violence and harassment, under Article 13. Affects pregnant and postpartum women, as well as the father of the newborn, within the period established in Article 15 of Law 1483/1984 (A’ 153), unless a serious reason exists (...)

Article 55. Καθιέρωση χρονικών ορίων εργασίας 1. Σε όλους ανεξαιρέτως τους κλάδους εργασίας και σε όλους τους τομείς οικονομικής δραστηριότητας, η πλήρης απασχόληση καθορίζεται σε σαράντα (40) ώρες εβδομαδιαίως, οι οποίες δύνανται να κατανέμονται σε πενθήμερη ή εξαήμερη εβδομαδιαία εργασία, σύμφωνα με τις ισχύουσες διατάξεις, τις συλλογικές συμβάσεις εργασίας ή τις διαιτητικές αποφάσεις. Όταν εφαρμόζεται σύστημα πενθήμερης εβδομαδιαίας εργασίας, το πλήρες συμβατικό ωράριο εργασίας ανέρχεται ημερησίως σε οκτώ (8) ώρες, ενώ όταν εφαρμόζεται σύστημα εξαήμερης εβδομαδιαίας εργασίας, το πλήρες ωράριο εργασίας ανέρχεται σε έξι (6) ώρες και σαράντα (40) λεπτά ημερησίως. Με συλλογικές συμβάσεις εργασίας, διαιτητικές αποφάσεις ή ατομικές συμβάσεις εργασίας είναι δυνατή η εφαρμογή μικρότερων ωραρίων πλήρους απασχόλησης ημερησίως και εβδομαδιαίως.

ENGLISH TRANSLATION
Article 55. Establishment of working time limits 1. In all branches of work and in all sectors of economic activity without exception, full-time work shall be fixed at forty (40) hours per week, which may be divided into five- or six-day working weeks, in accordance with the provisions in force, collective agreements or arbitration decisions. Where a five-day working week is applied, the full contractual working time shall be eight (8) hours per day, and where a six-day working week is applied, the full contractual working time shall be six (6) hours and forty (40) minutes per day. Collective agreements, arbitration awards or individual employment contracts may provide for shorter full-time working hours per day and per week.
