Labour Modernisation Act (Act No. 27,802)

Summary

The Labour Modernisation Act amends labour legislation and establishes a national scheme for independent providers of passenger mobility and delivery services operating through technological platforms. The Act defines these providers as independent and provides that they are free to connect to one or more platforms, accept or reject requests, and determine when and for how long they provide services. It also establishes provisions on social security contributions, remuneration, data portability, road safety, accident insurance, suspension of access to the digital infrastructure, and the right to request explanations regarding decisions affecting their activity. The Act provides that the rights granted to independent providers do not constitute evidence of an employment relationship or of subordination or dependence.
