Article L7341-1. Le présent titre est applicable aux travailleurs indépendants recourant, pour l'exercice de leur activité professionnelle, à une ou plusieurs plateformes de mise en relation par voie électronique définies à l'article 242 bis du code général des impôts. 

ENGLISH TRANSLATION

Article L7341-1. This title applies to self-employed workers who use one or more online intermediation platforms, as defined in Article 242 bis of the General Tax Code, for the exercise of their professional activity.

Article L7343-36. Une négociation est engagée au moins une fois par an au niveau du secteur, sur un ou plusieurs des thèmes suivants : 1. Les modalités de détermination des revenus des travailleurs, y compris le prix de leur prestation de service ; 2. Les conditions d'exercice de l'activité professionnelle des travailleurs, et notamment l'encadrement de leur temps d'activité ainsi que les effets des algorithmes et des changements les affectant sur les modalités d'accomplissement des prestations ; 3. La prévention des risques professionnels auxquels les travailleurs peuvent être exposés en raison de leur activité ainsi que les dommages causés à des tiers ; 4. Les modalités de développement des compétences professionnelles et de sécurisation des parcours professionnels. 

ENGLISH TRANSLATION

Article L7343-36. A negotiation is initiated at the sectoral level at least once a year on one or more of the following topics: 1. The methods for determining workers' income, including the pricing of their service provision; 2. The conditions under which workers carry out their professional activity, particularly the regulation of their working time, as well as the effects of algorithms and changes affecting them on the conditions for performing services; 3. The prevention of occupational risks to which workers may be exposed due to their activity, as well as harm caused to third parties; 4. The methods for developing professional skills and ensuring career security.

Article L7342-10. Tout litige concernant la conformité de la charte aux dispositions du présent titre, l'homologation ou le refus d'homologation relève de la compétence du tribunal judiciaire dont le siège et le ressort sont fixés par décret, à l'exclusion de tout autre recours contentieux ou administratif. Le recours doit être formé, à peine d'irrecevabilité, par la plateforme, avant l'expiration d'un délai de deux mois à compter de la notification de la décision d'homologation de la charte ou, par le travailleur, avant l'expiration d'un délai de deux mois à compter de la date à laquelle cette décision a été portée à sa connaissance par tout moyen conférant date certaine (…) 

ENGLISH TRANSLATION 

Article L7342-10. Any dispute concerning the compliance of the charter with the provisions of this title, its approval or refusal of approval falls within the jurisdiction of the judicial court, the seat and territorial jurisdiction of which are determined by decree, to the exclusion of any other contentious or administrative appeal. The appeal must be lodged, under penalty of inadmissibility, by the platform before the expiry of a period of two months from the notification of the decision approving the charter, or by the worker before the expiry of a period of two months from the date on which this decision was brought to their attention by any means providing a certain date (…)

Article L7342-6. Les travailleurs mentionnés à l'article L. 7341-1 bénéficient du droit de constituer une organisation syndicale, d'y adhérer et de faire valoir par son intermédiaire leurs intérêts collectifs.

Article L7342-6. The workers mentioned in Article L. 7341-1 have the right to form a trade union, to join one, and to assert their collective interests through it.

Article L7342-9. Dans le cadre de sa responsabilité sociale à l'égard des travailleurs mentionnés à l'article L. 7342-8, la plateforme peut établir une charte déterminant les conditions et modalités d'exercice de sa responsabilité sociale, définissant ses droits et obligations ainsi que ceux des travailleurs avec lesquels elle est en relation. Cette charte, qui rappelle les dispositions du présent chapitre, précise notamment : (...) b) A prévenir les risques professionnels auxquels les travailleurs peuvent être exposés en raison de leur activité ainsi que les dommages causés à des tiers.

Article L7342-9. As part of its social responsibility towards the workers mentioned in Article L. 7342-8, the platform may establish a charter outlining the conditions and modalities for exercising its social responsibility, defining its rights and obligations as well as those of the workers with whom it engages. This charter, which recalls the provisions of this chapter, shall specifically include: (...) b) Measures to prevent occupational risks to which workers may be exposed due to their activity, as well as harm caused to third parties.

Article L7342-9. Dans le cadre de sa responsabilité sociale à l'égard des travailleurs mentionnés à l'article L. 7342-8, la plateforme peut établir une charte déterminant les conditions et modalités d'exercice de sa responsabilité sociale, définissant ses droits et obligations ainsi que ceux des travailleurs avec lesquels elle est en relation. Article L7342-2. Lorsque le travailleur souscrit une assurance couvrant le risque d'accidents du travail ou adhère à l'assurance volontaire en matière d'accidents du travail mentionnée à l'article L. 743-1 du code de la sécurité sociale, la plateforme prend en charge sa cotisation, dans la limite d'un plafond fixé par décret. Ce plafond ne peut être supérieur à la cotisation prévue au même article L. 743-1. 

ENGLISH TRANSLATION 

Article L7342-2. When a worker subscribes to insurance covering the risk of occupational accidents or joins the voluntary occupational accident insurance scheme mentioned in Article L. 743-1 of the Social Security Code, the platform covers their contribution, up to a ceiling set by decree. This ceiling cannot exceed the contribution specified in the same Article L. 743-1.

Article L7343-13. Lorsque le représentant désigné en application de l'article L. 7343-12 recourt, comme travailleur indépendant, à une plateforme pour l'exercice de son activité professionnelle, la rupture du contrat commercial ne peut intervenir à l'initiative de la plateforme qu'après autorisation de l'Autorité des relations sociales des plateformes d'emploi mentionnée à l'article L. 7345-1 (…)

Article L7343-13. When the representative designated under Article L. 7343-12 engages with a platform as a self-employed worker for the exercise of their professional activity, the termination of the commercial contract cannot be initiated by the platform without prior authorisation from the Authority for Social Relations of Employment Platforms, as mentioned in Article L. 7345-1 (...)

Article L7342-7. Les travailleurs mentionnés à l'article L. 7341-1 bénéficient du droit d'accès à l'ensemble des données concernant leurs activités propres au sein de la plateforme et permettant de les identifier.

Article L7342-7. The workers mentioned in Article L. 7341-1 have the right to access all data related to their activities within the platform and allowing their identification.

Article L2242-17. (...) 7. Les modalités du plein exercice par le salarié de son droit à la déconnexion et la mise en place par l'entreprise de dispositifs de régulation de l'utilisation des outils numériques, en vue d'assurer le respect des temps de repos et de congé ainsi que de la vie personnelle et familiale. A défaut d'accord, l'employeur élabore une charte, après avis du comité social et économique. Cette charte définit ces modalités de l'exercice du droit à la déconnexion et prévoit en outre la mise en œuvre, à destination des salariés et du personnel d'encadrement et de direction, d'actions de formation et de sensibilisation à un usage raisonnable des outils numériques.

Article L2242-17. (...) 7. The arrangements for the full exercise by employees of their right to disconnect and the introduction by the company of mechanisms to regulate the use of digital tools, with a view to ensuring respect for rest and holiday times and for personal and family life. In the absence of an agreement, the employer draws up a charter, after consulting the social and economic committee. This charter defines the procedures for exercising the right to disconnect and also provides for the implementation of training and awareness-raising initiatives for employees and supervisory and management staff on the reasonable use of digital tools.
