Summary
The Labour Act as amended by Law NN 151/22 of 20 December 2022. The Labour Act establishes the legal framework for employment relations in Croatia. The 2022 amendment (Law NN 151/22) introduces specific provisions relating to a rebuttable presumption of employment when certain indicators are present. This presumption does not apply when earnings fall below a defined threshold. The amendment also includes new requirements for contracts with unpredictable working hours, mandatory contents of written employment contracts, and obligations for digital platforms to keep official records of workers’ income and work activity.

Pretpostavka postojanja radnog odnosa u radu korištenjem digitalne radne platforme. Članak 221.m
1. Ako digitalna radna platforma ili agregator iz članka 221.c ovoga Zakona s fizičkom osobom sklopi ugovor za obavljanje posla korištenjem digitalne radne platforme koji, s obzirom na narav i vrstu rada te ovlasti digitalne radne platforme ili agregatora, ima obilježja posla za koji se zasniva radni odnos, smatra se da je ta digitalna radna platforma ili taj agregator, kao poslodavac s radnikom sklopio ugovor o radu, osim ako se ne dokaže suprotno.
2. Činjenice na temelju kojih se može u smislu stavka 1. ovoga članka pretpostaviti postojanje radnog odnosa su: 1. osobno obavljanje naplatnog posla 2. davanje naloga i uputa za obavljanje posla fizičkoj osobi, u okvirima organizacije rada i subordinacije posla 3. ograničavanje slobode odbijanja izvršavanja naloga ili njezino uvjetovanje zapriječenim sankcijama ili drugim mjerama 4. pobliže određivanje vremena, mjesta i načina obavljanja posla fizičkoj osobi, neovisno o tome koristi li vlastita sredstva rada 5. nadziranje obavljanja posla i praćenje učinaka fizičke osobe, radi ocjene njezina rada te mogućnosti napredovanja 6. zabrana sklapanja poslova za svoj ili tuđi račun korištenjem usluga drugih platformi.
3. Teret dokaza je na onoj digitalnoj radnoj platformi ili na agregatoru koji osporava zakonsku pretpostavku iz stavka 1. ovoga članka.
4. Fizička osoba koja smatra da nije radnik u smislu ovoga Zakona može osporavati zakonsku pretpostavku postojanja radnog odnosa iz stavka 1. ovoga članka, pri čemu je digitalna radna platforma, odnosno agregator, u svrhu dokazivanja i radi pravilnog rješavanja pokrenutog postupka, dužan dati sve potrebne podatke.
Rad putem digitalnih radnih platformi ovisno o opsegu ostvarenih primitaka. Članak 221.n
1. Iznimno od članka 221.m ovoga Zakona, pretpostavka postojanja radnog odnosa ne odnosi se na fizičku osobu koja radom putem digitalnih radnih platformi u pojedinom kvartalu kalendarske godine nije ostvarila primitak veći od 60 % brutoiznosa tri mjesečne minimalne plaće utvrđenog posebnim propisom.
2. Digitalna radna platforma ili agregator dužan je izvršiti provjeru od nadležnog tijela koje putem sustava ePorezna vodi službenu evidenciju o svim isplatiteljima i o isplaćenim primicima radi pribavljanja dokaza o stanju isplaćenih primitaka od kojih se utvrđuje drugi dohodak koji je fizička osoba kojoj dodjeljuje posao ostvarila radom putem digitalnih radnih platformi.
3. Nadležno tijelo koje putem sustava ePorezna vodi službenu evidenciju o svim isplatiteljima i o isplaćenim primicima može digitalnoj radnoj platformi ili agregatoru omogućiti uvid u podatke o stanju isplaćenih primitaka od kojih se utvrđuje drugi dohodak fizičke osobe kojoj se dodjeljuje, a koje je ta fizička osoba ostvarila radom putem digitalnih radnih platformi.
4. Ako je digitalnoj radnoj platformi ili agregatoru omogućeno da na temelju izvršene provjere iz stavka 2. ovoga članka utvrdi da je primitak za obavljeni rad fizičke osobe iz stavka 1. ovoga članka u pojedinom kvartalu kalendarske godine veći od limitirane visine od 60 % brutoiznosa tri mjesečne minimalne plaće utvrđenog posebnim propisom, fizička osoba kod tog poslodavca, nakon izvršene provjere, može posao obavljati samo na temelju sklopljenog ugovora o radu.
5. Radi provjere stanja isplaćenih primitaka fizičke osobe iz stavka 1. ovoga članka, digitalna radna platforma ili agregator ovlašten je dobiti samo podatak o iznosu neisplaćenog dijela limitirane visine iznosa primitaka iz stavka 2. ovoga članka.
6. Način i rokove provođenja uvida i provjere iz stavaka 2. i 3. ovoga članka ministar, uz suglasnost ministra nadležnog za financije, propisuje pravilnikom.

Presumption of the existence of an employment relationship in work performed using a digital labour platform. Article 221.m
1. If a digital labour platform or an aggregator referred to in Article 221.c of this Act concludes a contract with a natural person for the performance of work using a digital labour platform which, having regard to the nature and type of the work and the powers of the digital labour platform or aggregator, has the characteristics of work for which an employment relationship is established, it shall be considered that the digital labour platform or the aggregator, as the employer, has concluded an employment contract with the worker, unless proven otherwise.
2. The facts on the basis of which the existence of an employment relationship may be presumed within the meaning of paragraph 1 of this Article include: the personal performance of paid work; the giving of orders and instructions for the performance of the work to the natural person, within the framework of work organisation and subordination; the restriction of freedom to refuse instructions or making such refusal conditional on threats of sanctions or other measures; the specific determination of the time, place, and manner of performing the work by the natural person, regardless of whether their own work equipment is used; the supervision of the performance of the work and the monitoring of the results of the natural person, for the purpose of evaluating their work and potential advancement; the prohibition of entering into contracts for their own or another’s account using the services of other platforms.
3. The burden of proof lies with the digital labour platform or the aggregator that disputes the legal presumption referred to in paragraph 1 of this Article.
4. A natural person who considers that they are not a worker within the meaning of this Act may challenge the legal presumption of the existence of an employment relationship referred to in paragraph 1 of this Article, whereby the digital labour platform or the aggregator, for the purpose of providing evidence and for the proper resolution of the initiated proceedings, is obliged to provide all necessary information.
Work through digital labour platforms depending on the scope of earned income. Article 221.n
1. By way of exception to Article 221.m of this Act, the presumption of the existence of an employment relationship does not apply to a natural person who, through work on digital labour platforms, has not earned in a given quarter of the calendar year an amount exceeding 60% of the gross amount of three monthly minimum wages, as determined by a special regulation.
2. The digital labour platform or aggregator shall obtain verification from the competent authority, which maintains an official record through the ePorezna system of all payers and paid income, in order to obtain proof of the amount of income paid from which other income is determined, earned by the natural person performing work through digital labour platforms.
3. The competent authority that maintains the official record via the ePorezna system may allow the digital labour platform or aggregator to access data on the amount of income paid from which other income is determined, relating to the natural person to whom the work is assigned and which was earned through digital labour platforms.
4. If the digital labour platform or aggregator, based on the verification referred to in paragraph 2 of this Article, determines that the income earned by the natural person referred to in paragraph 1 in a given calendar quarter exceeds the 60% limit of the gross amount of three monthly minimum wages as set by special regulation, the natural person may thereafter perform work for that employer only on the basis of an employment contract.
5. For the purpose of verifying the income of the natural person referred to in paragraph 1 of this Article, the digital labour platform or aggregator is authorised to receive only the information on the unpaid portion of the income amount up to the threshold referred to in paragraph 2 of this Article.
6. The method and deadlines for carrying out the inspections and verifications referred to in paragraphs 2 and 3 of this Article shall be prescribed by the Minister, with the consent of the Minister responsible for finance, through a rulebook.
Digital labour platform – Article 221.c (...) 2. An aggregator, for the purposes of this Act, is a natural or legal person who carries out the activity of representation or intermediation for one or more digital labour platforms referred to in paragraph 1 of this Article.

Obveza ljudskog nadzora u automatiziranom sustavu upravljanja radi zaštite sigurnosti i zdravlja radnika. Članak 221.h
1. Poslodavac iz članka 221.d stavka 1. ovoga Zakona dužan je procijeniti rizike rada i njihova utjecaja na sigurnost i zdravlje radnika koji rad obavlja korištenjem digitalne radne platforme.
2. Poslodavac iz članka 221.d stavka 1. ovoga Zakona ne smije dopustiti intenzitet rada koji ugrožava fizičko, odnosno mentalno zdravlje radnika koji rad obavlja korištenjem digitalne radne platforme.
3. Radnik koji smatra da mu je zbog okolnosti nastalih radom korištenjem digitalne radne platforme povrijeđeno pravo na sigurnost i zdravlje na radu ima pravo zatražiti od poslodavca zaštitu svoga prava odnosno pisano obrazloženje i preispitivanje pojedine mjere ili odluke.
4. Nadzor nad donošenjem odluka vezanih za sigurnost i zdravlje radnika i ovlaštenje za preispitivanje i ocjenu mjere ili odluke o zaštiti na radu te odlučivanje o tome ima osoba iz članka 221.g stavka 1. točke 3. ovoga Zakona.
Prava i uvjeti rada ostalih osoba koje rade na digitalnim radnim platformama. Članak 221.o
1. Na osobu iz članka 221.f stavka 1. ovoga Zakona na odgovarajući se način primjenjuju odredbe članaka 221.g do 221.k ovoga Zakona.
2. Digitalna radna platforma ili agregator dužan je za osobu iz članka 221.f stavka 1. ovoga Zakona ugovoriti osiguranje od nesretnog slučaja i osiguranje od odgovornosti ako ugovorene poslove obavlja sudjelovanjem u prometu sredstvom koje se u smislu propisa o sigurnosti prometa na cestama smatra vozilom i koje ne podliježe obvezi registracije.
3. Osoba iz članka 221.f stavka 1. ovoga Zakona ima pravo na zaštitu prava u skladu s utvrđenim ugovornim odnosom s digitalnom radnom platformom ili agregatorom.

Obligation of human oversight in the automated management system for the protection of workers' safety and health. Article 221.h
1. The employer referred to in Article 221.d, paragraph 1 of this Act is required to assess work-related risks and their impact on the safety and health of workers performing tasks through a digital labour platform.
2. The employer referred to in Article 221.d, paragraph 1 of this Act must not allow a work intensity that endangers the physical or mental health of workers performing tasks using a digital labour platform.
3. A worker who believes that their right to occupational safety and health has been violated due to working conditions on a digital labour platform has the right to request protection of their rights from the employer, as well as a written explanation and a review of a specific measure or decision.
4. The supervision of decision-making related to worker safety and health, as well as the authority to review and evaluate measures or decisions on occupational safety, and the power to issue a ruling on such matters, is entrusted to the person referred to in Article 221.g, paragraph 1, point 3 of this Act.
Rights and working conditions of other persons working on digital labour platforms. Article 221.o
1. The provisions of Articles 221.g to 221.k of this Act shall apply accordingly to the person referred to in Article 221.f, paragraph 1 of this Act.
2. The digital labour platform or aggregator is obliged to provide accident insurance and liability insurance for the person referred to in Article 221.f, paragraph 1 of this Act, if the contracted tasks are performed through participation in traffic using a means of transport which, under the provisions on road traffic safety, is considered a vehicle and which is not subject to registration requirements.
3. The person referred to in Article 221.f, paragraph 1 of this Act shall have the right to the protection of their rights in accordance with the established contractual relationship with the digital labour platform or aggregator.

Zaštita privatnosti i obrada osobnih podataka radnika koji rade korištenjem digitalne radne platforme. Članak 221.j
Digitalna radna platforma i agregator, radi zaštite privatnosti radnika u skladu s člankom 29. ovoga Zakona, pri obradi osobnih podataka ne smije: 1. obrađivati podatke o privatnim razgovorima 2. obrađivati podatke o emocionalnom odnosno psihološkom stanju radnika 3. obrađivati podatke o zdravlju radnika, osim u slučajevima predviđenim propisom o zaštiti osobnih podataka 4. prikupljati osobne podatke u razdoblju u kojem radnik ne obavlja rad niti ga nudi.
Prava i uvjeti rada ostalih osoba koje rade na digitalnim radnim platformama. Članak 221.o
1. Na osobu iz članka 221.f stavka 1. ovoga Zakona na odgovarajući se način primjenjuju odredbe članaka 221.g do 221.k ovoga Zakona.
2. Digitalna radna platforma ili agregator dužan je za osobu iz članka 221.f stavka 1. ovoga Zakona ugovoriti osiguranje od nesretnog slučaja i osiguranje od odgovornosti ako ugovorene poslove obavlja sudjelovanjem u prometu sredstvom koje se u smislu propisa o sigurnosti prometa na cestama smatra vozilom i koje ne podliježe obvezi registracije.
3. Osoba iz članka 221.f stavka 1. ovoga Zakona ima pravo na zaštitu prava u skladu s utvrđenim ugovornim odnosom s digitalnom radnom platformom ili agregatorom.

Protection of privacy and processing of personal data of workers performing work using a digital labour platform. Article 221.j
The digital labour platform and the aggregator, in order to protect the privacy of workers in accordance with Article 29 of this Act, shall not, when processing personal data: 1. process data relating to private conversations 2. process data relating to the emotional or psychological state of the worker 3. process data relating to the health of the worker, except in cases provided for by data protection regulations 4. collect personal data during periods in which the worker is not performing work nor offering to do so.
