Summary
This Act establishes the legal framework for industrial accident compensation insurance in the Republic of Korea. The 2022 amendment, introduces provisions specific to labour providers, including those operating via platforms. The amendments covered definitions, standards for insurance benefit calculations, request for provision of data to platform operators, between others.

제91조의15 (노무제공자 등의 정의) 이 장에서 사용하는 용어의 뜻은 다음과 같다.
1. “노무제공자” 란 자신이 아닌 다른 사람의 사업을 위하여 다음 각 목의 어느 하나에 해당하는 방법에 따라 자신이 직접 노무를 제공하고 그 대가를 지급받는 사람으로서 업무상 재해로부터의 보호 필요성, 노무제공 형태 등을 고려하여 대통령령으로 정하는 직종에 종사하는 사람을 말한다. 가. 노무제공자가 사업주로부터 직접 노무제공을 요청받은 경우 나. 노무제공자가 사업주로부터 일하는 사람의 노무제공을 중개ㆍ알선하기 위한 전자적 정보처리시스템(이하 “온라인 플랫폼”이라 한다)을 통해 노무제공을 요청받는 경우.
2. “플랫폼 종사자” 란 온라인 플랫폼을 통해 노무를 제공하는 노무제공자를 말한다.
3. “플랫폼 운영자” 란 온라인 플랫폼을 이용하여 플랫폼 종사자의 노무제공을 중개 또는 알선하는 것을 업으로 하는 자를 말한다.
4. “플랫폼 이용 사업자” 란 플랫폼 종사자로부터 노무를 제공받아 사업을 영위하는 자를 말한다. 다만, 플랫폼 운영자가 플랫폼 종사자의 노무를 직접 제공받아 사업을 영위하는 경우 플랫폼 운영자를 플랫폼 이용 사업자로 본다.
5. “보수” 란 노무제공자가 이 법의 적용을 받는 사업에서 노무제공의 대가로 지급받은 「소득세법」 제19조에 따른 사업소득 및 같은 법 제21조에 따른 기타소득에서 대통령령으로 정하는 금품을 뺀 금액을 말한다. 다만, 노무제공의 특성에 따라 소득확인이 어렵다고 대통령령으로 정하는 직종의 보수는 고용노동부장관이 고시하는 금액으로 한다.
6. “평균보수” 란 이를 산정하여야 할 사유가 발생한 날이 속하는 달의 전전달 말일부터 이전 3개월 동안 노무제공자가 재해가 발생한 사업에서 지급받은 보수와 같은 기간 동안 해당 사업 외의 사업에서 지급받은 보수를 모두 합산한 금액을 해당 기간의 총 일수로 나눈 금액을 말한다. 다만, 노무제공의 특성에 따라 소득확인이 어렵거나 소득의 종류나 내용에 따라 평균보수를 산정하기 곤란하다고 인정되는 경우에는 고용노동부장관이 고시하는 금액으로 한다.
제91조의16 (다른 조문과의 관계)
1. 제5조제2호에도 불구하고 노무제공자는 이 법의 적용을 받는 근로자로 본다. ② 제6조에도 불구하고 노무제공자의 노무를 제공받는 사업은 이 법의 적용을 받는 사업으로 본다.
ENGLISH TRANSLATION
Article 91-15. The meanings of the terms used in this Chapter shall be as follows:
1. The term “labour provider” means a person who, for the business of another, directly provides his or her own labour and receives remuneration therefor, and who is engaged in an occupation prescribed by Presidential Decree in consideration of the necessity of protection against occupational accidents, the form of labour provision, and other relevant factors, under any of the following circumstances:
(a) Where the labour provider is directly requested by the business owner to provide labour;
(b) Where the labour provider is requested by the business owner, through an electronic information processing system (hereinafter referred to as “online platform”) established for the mediation or arrangement of labour provision, to provide labour.2. The term “platform worker” means a labour provider who provides labour through an online platform.
3. The term “platform operator” means a person whose business is to mediate or arrange, through an online platform, the provision of labour by platform workers.
4. The term “platform-utilising business owner” means a person who conducts a business by receiving labour provided by platform workers: Provided, That where a platform operator directly receives labour from a platform worker in order to conduct a business, such platform operator shall be deemed a platform-utilising business owner.
5. The term “remuneration” means the amount of business income under Article 19 of the Income Tax Act and other income under Article 21 of the same Act, paid as consideration for the provision of labour in a business subject to this Act, less the money and valuables prescribed by Presidential Decree. Provided, That where, due to the characteristics of labour provision, it is difficult to verify income for an occupation prescribed by Presidential Decree, the amount notified by the Minister of Employment and Labour shall be deemed the remuneration.
6. The term “average remuneration” means the amount obtained by dividing the total sum of remuneration received by a labour provider from the business in which the accident occurred and remuneration received from other businesses during the three-month period immediately preceding the month prior to the month in which the grounds for calculation arise, by the total number of days in that period: Provided, That where, due to the characteristics of labour provision, it is difficult to verify income, or where it is deemed difficult to calculate the average remuneration depending on the type or nature of income, the amount notified by the Minister of Employment and Labour shall be deemed the average remuneration.
Article 91-16. Relationship with Other Provisions
1. Notwithstanding Article 5 subparagraph 2, a labour provider shall be deemed a worker subject to this Act. 2. Notwithstanding Article 6, any business which receives labour provided by a labour provider shall be deemed a business subject to this Act.

제91조의18 (노무제공자에 대한 업무상의 재해의 인정기준)
노무제공자에 대한 업무상의 재해의 인정기준은 제37조제1항부터 제4항까지의 규정을 적용하되 구체적인 인정기준은 노무제공 형태 등을 고려하여 대통령령으로 정한다.

Article 91-18. Criteria for Recognition of Occupational Accidents for Labour Providers
The criteria for the recognition of occupational accidents for labour providers shall be governed by the provisions of Article 37(1) through (4), and the specific criteria for such recognition shall be prescribed by Presidential Decree, taking into account the form of labour provision and other relevant factors.

제91조의17 (노무제공자에 대한 보험급여의 산정기준 등)
1. 노무제공자의 평균보수 산정사유 발생일은 대통령령으로 정한다.
2. 노무제공자에 대해 제3장 및 제3장의2에 따른 보험급여에 관한 규정을 적용할 때에는 “임금”은 “보수”로, “평균임금”은 “평균보수”로 본다.
3. 제91조의15제6호에도 불구하고 업무상 재해를 입은 노무제공자가 평균보수 산정기간 동안 근로자(대통령령으로 정하는 일용근로자는 제외한다)로서 지급받은 임금이 있는 경우에는 그 기간의 보수와 임금을 합산한 금액을 해당 기간의 총일수로 나누어 평균보수를 산정한다.
4. 제36조제3항 본문에도 불구하고 노무제공자에 대한 보험급여를 산정하는 경우 해당 노무제공자의 평균보수를 산정하여야 할 사유가 발생한 날부터 1년이 지난 이후에는 매년 소비자물가변동률에 따라 평균보수를 증감한다.
5. 노무제공자에 대한 보험급여의 산정에 관하여는 제36조제5항 및 제6항은 적용하지 아니한다.
제91조의19 (노무제공자에 대한 보험급여 산정 특례)
1. 노무제공자에 대해서는 제54조에도 불구하고 제52조에 따라 산정한 1일당 휴업급여 지급액이 대통령령으로 정하는 최저 휴업급여 보장액(이하 “최저 휴업급여 보장액”이라 한다)보다 적으면 최저 휴업급여 보장액을 1일당 휴업급여 지급액으로 한다.
2. 재요양을 받는 노무제공자에 대해서는 제56조제2항에도 불구하고 제56조제1항에 따라 산정한 1일당 휴업급여 지급액이 최저 휴업급여 보장액보다 적거나 재요양 당시 평균보수 산정의 대상이 되는 보수가 없으면 최저 휴업급여 보장액을 1일당 휴업급여 지급액으로 한다.
3. 장해보상연금을 지급받는 노무제공자가 재요양하는 경우에는 제56조제3항에도 불구하고 1일당 장해보상연금액과 제2항 또는 제56조제1항에 따라 산정한 1일당 휴업급여 지급액을 합한 금액이 장해보상연금의 산정에 적용되는 평균보수의 100분의 70을 초과하면 그 초과하는 금액 중 휴업급여에 해당하는 금액은 지급하지 아니한다.
4. 제1항 및 제2항에 따라 최저 휴업급여 보장액을 1일당 휴업급여 지급액으로 하는 노무제공자가 그 요양기간 중 일정기간 또는 단시간 취업을 하는 경우에는 제53조제1항 단서에도 불구하고 최저 휴업급여 보장액(별표 1 제2호에 따라 감액하는 경우에는 그 감액한 금액)에서 취업한 날에 대한 보수를 뺀 금액을 부분휴업급여로 지급할 수 있다.
제91조의20(노무제공자에 대한 보험급여의 지급)
1. 노무제공자의 보험급여는 보험료징수법에 따라 공단에 신고된 해당 노무제공자의 보수를 기준으로 평균보수를 산정한 후 그에 따라 지급한다.
2. 수급권자는 신고 누락 등으로 인하여 제1항에 따라 산정된 평균보수가 실제 평균보수와 다르게 산정된 경우에는 보험료징수법으로 정하는 바에 따라 보수에 대한 정정신고를 거쳐 이 법에 따른 평균보수 및 보험급여의 정정청구를 할 수 있다.
3. 노무제공자에 대한 보험급여의 지급 등에 필요한 사항은 고용노동부령으로 정한다.
ENGLISH TRANSLATION
Article 91-17. Standards for Calculation of Insurance Benefits for Labour Providers, etc.
1. The date on which grounds arise for calculating the average remuneration of a labour provider shall be prescribed by Presidential Decree.
2. When applying the provisions concerning insurance benefits under Chapter III and Chapter III-2 to a labour provider, the term “wage” shall be construed as “remuneration,” and the term “average wage” shall be construed as “average remuneration.”
3. Notwithstanding subparagraph 6 of Article 91-15, where a labour provider who has sustained an occupational injury has received wages as a worker (excluding daily workers prescribed by Presidential Decree) during the period for calculating the average remuneration, the total of such remuneration and wages for the period shall be divided by the total number of days in that period, and the result shall constitute the average remuneration.
4. Notwithstanding the main text of Article 36(3), in calculating insurance benefits for a labour provider, where more than one year has elapsed since the date on which grounds for calculating the average remuneration arose, such average remuneration shall be increased or decreased annually in accordance with changes in the consumer price index.
5. Article 36(5) and (6) shall not apply to the calculation of insurance benefits for labour providers.
Article 91-19. Special Provisions on the Calculation of Insurance Benefits for Labour Providers
1. Notwithstanding Article 54, where the amount of daily temporary incapacity benefits calculated pursuant to Article 52 for a labour provider is less than the minimum guaranteed daily temporary incapacity benefit amount prescribed by Presidential Decree (hereinafter referred to as the “minimum guaranteed daily temporary incapacity benefit”), such minimum guaranteed daily temporary incapacity benefit shall be deemed the daily temporary incapacity benefit amount.
2. Notwithstanding Article 56(2), where the amount of daily temporary incapacity benefits calculated pursuant to Article 56(1) for a labour provider receiving re-treatment is less than the minimum guaranteed daily temporary incapacity benefit, or where there exists no remuneration that may serve as the basis for the calculation of the average remuneration at the time of re-treatment, the minimum guaranteed daily temporary incapacity benefit shall be deemed the daily temporary incapacity benefit amount.
3. In cases where a labour provider in receipt of disability compensation pension undergoes re-treatment, notwithstanding Article 56(3), if the aggregate of the daily disability compensation pension amount and the daily temporary incapacity benefit amount calculated pursuant to paragraph (2) or Article 56(1) exceeds seventy percent of the average remuneration applied to the calculation of the disability compensation pension, the portion corresponding to the temporary incapacity benefit exceeding such limit shall not be paid.
4. In cases where a labour provider whose daily temporary incapacity benefit amount is deemed the minimum guaranteed daily temporary incapacity benefit pursuant to paragraphs (1) and (2) engages in employment for a certain period or on a part-time basis during the period of medical care, notwithstanding the proviso of Article 53(1), partial temporary incapacity benefits may be paid in an amount equivalent to the minimum guaranteed daily temporary incapacity benefit (or, where reduced pursuant to subparagraph 2 of the Schedule, the reduced amount) less the remuneration earned on the day of such employment.
Article 91-20. Payment of Insurance Benefits to Labour Providers
1. Insurance benefits for a labour provider shall be paid based on the average remuneration calculated on the basis of the remuneration of the labour provider reported to the Corporation pursuant to the Insurance Premium Collection Act.
2. Where the average remuneration calculated under paragraph (1) differs from the actual average remuneration due to an omission in reporting or other reasons, the beneficiary may, after filing a correction of remuneration in accordance with the Insurance Premium Collection Act, request a correction of the average remuneration and insurance benefits under this Act.
3. Matters necessary for the payment of insurance benefits to labour providers shall be prescribed by Ordinance of the Ministry of Employment and Labour.

제91조의21 (플랫폼 운영자에 대한 자료제공 등의 요청)
공단은 플랫폼 종사자에 관한 보험사무의 효율적 처리를 위하여 플랫폼 운영자에게 해당 온라인 플랫폼의 이용 및 보험관계의 확인에 필요한 다음 각 호의 자료 또는 정보의 제공을 요청할 수 있다. 이 경우 요청을 받은 플랫폼 운영자는 정당한 사유가 없으면 그 요청에 따라야 한다.
1. 플랫폼 이용 사업자 및 플랫폼 종사자의 온라인 플랫폼 이용 개시일 또는 종료일
2. 플랫폼 이용 사업자의 보험관계와 관련된 사항으로서 사업장의 명칭ㆍ주소 등 대통령령으로 정하는 정보
3. 플랫폼 종사자의 보험관계 및 보험급여의 결정과 지급 등과 관련된 사항으로서 플랫폼 종사자의 이름ㆍ직종ㆍ보수ㆍ노무제공 내용 등 대통령령으로 정하는 자료 또는 정보
ENGLISH TRANSLATION
Article 91-21. Request for Provision of Data, etc. by Platform Operators
For the efficient administration of insurance affairs relating to platform workers, the Corporation may request a platform operator to provide the following data or information necessary for verifying the use of the relevant online platform and the insurance relationship. In such cases, unless there is a justifiable reason, the platform operator so requested shall comply with such request.
1. The date of commencement or termination of the use of the online platform by the platform-utilising business owner and the platform worker;
2. Matters related to the insurance relationship of the platform-utilising business owner, including the name, address of the business establishment, and other information prescribed by Presidential Decree;
3. Matters related to the insurance relationship of the platform worker and the determination and payment of insurance benefits, including the name, occupation, remuneration, details of labour provision of the platform worker, and other data or information prescribed by Presidential Decree.
