Summary
The Employment Insurance Act regulates the employment insurance system in the Republic of Korea. The 2021 amendments introduced provisions regarding the application to insured workers (" a person, not an employee..."). These provisions include the obligation for platform operators to report the acquisition of insured status for such workers and the possibility to be requested to provide further information.

제77조의6 (노무제공자인 피보험자에 대한 적용)
1. 근로자가 아니면서 자신이 아닌 다른 사람의 사업을 위하여 자신이 직접 노무를 제공하고 해당 사업주 또는 노무수령자로부터 일정한 대가를 지급받기로 하는 계약(이하 “노무제공계약”이라 한다)을 체결한 사람 중 대통령령으로 정하는 직종에 종사하는 사람(이하 “노무제공자”라 한다)과 이들을 상대방으로 하여 노무제공계약을 체결한 사업에 대해서는 제8조제2항에 따라 이 장을 적용한다.
2. 제1항에도 불구하고 노무제공자가 다음 각 호의 어느 하나에 해당하는 경우에는 이 법을 적용하지 아니한다. <개정 2022. 12. 31.> 1. 65세 이후에 근로계약, 노무제공계약 또는 문화예술용역 관련 계약(65세 전부터 피보험자격을 유지하던 사람이 65세 이후에 계속하여 근로계약, 노무제공계약 또는 문화예술용역 관련 계약을 체결한 경우는 제외한다)을 체결하거나 자영업을 개시하는 경우 2. 노무제공자 중 대통령령으로 정하는 소득 기준을 충족하지 못하는 경우. 다만, 노무제공자 중 계약의 기간이 1개월 미만인 사람(이하 “단기노무제공자”라 한다)은 제외한다. 3. 15세 미만인 경우. 다만, 15세 미만인 노무제공자로서 고용보험 가입을 원하는 사람은 대통령령으로 정하는 바에 따라 고용보험에 가입할 수 있다.

4. 제1항에 따라 이 장을 적용하는 노무제공자와 그와 노무제공계약을 체결한 사업의 사업주(이하 “노무제공사업의 사업주”라 한다)는 고용산재보험료징수법에 따라 보험료를 부담하며, 그 보험관계의 성립ㆍ소멸 및 변경, 보험료의 산정ㆍ납부 및 징수에 필요한 사항은 고용산재보험료징수법에서 정하는 바에 따른다.
ENGLISH TRANSLATION
Article 77-6. (Application to Insured Labour Providers)
1. This Chapter shall apply, pursuant to Article 8(2), to a person (hereinafter referred to as “labour provider”) who is not a worker but who, for the business of another, directly provides his or her own labour under a contract (hereinafter referred to as “labour provision contract”) entered into with the relevant business owner or recipient of labour, under which the person is to receive certain remuneration, and who is engaged in an occupation prescribed by Presidential Decree, and to the business which has entered into such labour provision contract with such person.
2. Notwithstanding paragraph (1), this Act shall not apply where a labour provider falls under any of the following subparagraphs: <Amended on Dec. 31, 2022>
(1) Where a person enters into a labour contract, labour provision contract, or contract for cultural or artistic services, or commences self-employment after attaining the age of 65: Provided, That this shall not apply where a person who maintained insured status prior to attaining the age of 65 continues to enter into a labour contract, labour provision contract, or contract for cultural or artistic services after attaining the age of 65;
(2) Where the labour provider fails to meet the income criteria prescribed by Presidential Decree: Provided, That a labour provider whose contract term is less than one month (hereinafter referred to as “short-term labour provider”) shall be excluded;
(3) Where the person is under 15 years of age: Provided, That a labour provider under 15 years of age who wishes to subscribe to employment insurance may do so in accordance with the Presidential Decree.3. Deleted. <Dec. 31, 2022>
4. A labour provider to whom this Chapter applies pursuant to paragraph (1), and the business owner of the business that has entered into a labour provision contract with such labour provider (hereinafter referred to as “business owner of a labour-providing business”), shall bear insurance premiums in accordance with the Act on the Collection of Employment Insurance and Industrial Accident Compensation Insurance Premiums, and matters necessary for the establishment, termination, and modification of the insurance relationship, and the calculation, payment, and collection of insurance premiums, shall be governed by the provisions of the said Act.

제17조 (피보험자격의 확인)
1. 피보험자 또는 피보험자였던 사람은 언제든지 고용노동부장관에게 피보험자격의 취득 또는 상실에 관한 확인을 청구할 수 있다. <개정 2010. 6. 4., 2020. 5. 26.>
2. 고용노동부장관은 제1항에 따른 청구에 따르거나 직권으로 피보험자격의 취득 또는 상실에 관하여 확인을 한다. <개정 2010. 6. 4.>
3. 고용노동부장관은 제2항에 따른 확인 결과를 대통령령으로 정하는 바에 따라 그 확인을 청구한 피보험자 및 사업주 등 관계인에게 알려야 한다. <개정 2010. 6. 4.>
제105조 (불이익 처우의 금지) 사업주는 근로자가 제17조에 따른 확인의 청구를 한 것을 이유로 그 근로자에게 해고나 그 밖의 불이익한 처우를 하여서는 아니 된다.
ENGLISH TRANSLATION
Article 17 (Verification of Insured Status)
1. An insured person or a person who was formerly insured may, at any time, request the Minister of Employment and Labour to verify the acquisition or loss of insured status. <Amended on Jun. 4, 2010; May 26, 2020>
2. The Minister of Employment and Labour shall verify the acquisition or loss of insured status either upon a request under paragraph (1) or ex officio. <Amended on Jun. 4, 2010>
3. The Minister of Employment and Labour shall, in accordance with Presidential Decree, notify the insured person who made the request for verification, the employer, and other interested parties of the result of the verification under paragraph (2). <Amended on Jun. 4, 2010>
Article 105 (Prohibition of Unfavourable Treatment) An employer shall not dismiss or otherwise subject a worker to unfavourable treatment on the grounds that the worker has made a request for verification under Article 17.

제77조의7 (노무제공플랫폼사업자에 대한 특례)
1. 제15조에도 불구하고 노무제공사업의 사업주가 노무제공자와 노무제공사업의 사업주에 관련된 자료 및 정보를 수집ㆍ관리하여 이를 전자정보 형태로 기록하고 처리하는 시스템(이하 “노무제공플랫폼”이라 한다)을 구축ㆍ운영하는 사업자(이하 “노무제공플랫폼사업자”라 한다)와 노무제공플랫폼 이용에 대한 계약(이하 “노무제공플랫폼이용계약”이라 한다)을 체결하는 경우 노무제공플랫폼사업자는 대통령령으로 정하는 바에 따라 노무제공자에 대한 제15조제1항에 따른 피보험자격의 취득 등을 신고하여야 한다.
2. 고용노동부장관은 노무제공자에 관한 보험사무의 효율적 처리를 위하여 노무제공플랫폼사업자에게 해당 노무제공플랫폼의 이용 및 보험관계의 확인에 필요한 다음 각 호의 자료 또는 정보의 제공을 요청할 수 있다. 이 경우 요청을 받은 노무제공플랫폼사업자는 정당한 사유가 없으면 그 요청에 따라야 한다. 1. 노무제공플랫폼이용계약의 개시일 또는 종료일 2. 노무제공사업의 사업주의 보험관계와 관련된 사항으로서 사업장의 명칭ㆍ주소 등 대통령령으로 정하는 자료 또는 정보 3. 노무제공자의 피보험자격과 관련된 사항으로서 노무제공자의 이름ㆍ직종ㆍ보수 등 대통령령으로 정하는 자료 또는 정보.
3. 노무제공플랫폼사업자는 제2항에 따라 요청받은 자료 또는 정보의 제공을 위하여 필요한 경우에는 해당 노무제공자와 노무제공사업의 사업주에게 필요한 자료 또는 정보의 제공을 요청할 수 있다. 이 경우 요청을 받은 노무제공자와 노무제공사업의 사업주는 정당한 사유가 없으면 그 요청에 따라야 한다.
4. 고용노동부장관은 제2항에 따라 노무제공플랫폼사업자가 제공한 자료 또는 정보를 해당 보험사무의 처리에 필요한 범위에서만 활용하여야 하며, 이를 공개해서는 아니 된다.
5. 노무제공플랫폼사업자는 제1항에 따른 노무제공자의 피보험자격 신고와 관련된 정보를 해당 노무제공자와 노무제공사업의 사업주 사이에 체결된 노무제공계약이 끝난 날부터 3년 동안 노무제공플랫폼에 보관하여야 한다.
ENGLISH TRANSLATION
Article 77-7. (Special Provisions for Labour Provision Platform Operators)
1. Notwithstanding Article 15, where the business owner of a labour-providing business enters into a contract for the use of a system (hereinafter referred to as “labour provision platform”), which records and processes in electronic form the data and information relating to the labour provider and the business owner of the labour-providing business and is established and operated by a person (hereinafter referred to as “labour provision platform operator”), such labour provision platform operator shall, in accordance with Presidential Decree, report the acquisition of insured status of the labour provider pursuant to Article 15(1), and other relevant matters.
2. For the efficient administration of insurance affairs concerning labour providers, the Minister of Employment and Labour may request a labour provision platform operator to provide the following data or information necessary for verifying the use of the relevant labour provision platform and the insurance relationship. In such cases, unless there is a justifiable reason, the labour provision platform operator so requested shall comply with such request:
(1) The date of commencement or termination of the labour provision platform use contract;
(2) Matters related to the insurance relationship of the business owner of a labour-providing business, including the name, address of the business establishment, and other data or information prescribed by Presidential Decree;
(3) Matters related to the insured status of the labour provider, including the name, occupation, and remuneration of the labour provider, and other data or information prescribed by Presidential Decree.3. Where necessary to provide the data or information requested under paragraph (2), a labour provision platform operator may request the relevant labour provider and the business owner of the labour-providing business to provide the necessary data or information. In such cases, unless there is a justifiable reason, the labour provider and the business owner of the labour-providing business so requested shall comply with such request.
4. The Minister of Employment and Labour shall use the data or information provided by a labour provision platform operator under paragraph (2) only to the extent necessary for the administration of the relevant insurance affairs and shall not disclose the same.
5. A labour provision platform operator shall retain, within the labour provision platform, the information related to the report of insured status of a labour provider under paragraph (1) for a period of three years from the date of termination of the labour provision contract concluded between the relevant labour provider and the business owner of the labour-providing business.
