Summary
This Decree regulates the application of Law No. 20.396 by clarifying that work on digital platforms may be performed under dependent or self-employed contracts, setting rules on collective bargaining, risk assessment of automated systems, occupational safety and health, access to welfare facilities, working time limits, remuneration methods and guarantees, data reporting in cases of accidents, transparency in algorithmic management, and access to the Monotributo regime for self-employed workers.

Artículo 10. Se entiende incluida en la obligación establecida para los patronos referida en el artículo 58° de la Ley N° 16.074, de 10 de octubre de 1989 toda la información con la que cuente la empresa titular de la plataforma digital sobre el siniestro laboral ocurrido, tal como la referida al tiempo de trabajo, logueo, pausa, aceptación de pedidos, GPS y cualquier otra vinculada al accidente de trabajo o enfermedad profesional sufrida por el trabajador. La empresa titular de la plataforma digital deberá proporcionar dicha información al Banco de Seguros del Estado en un plazo no mayor a 72 (setenta y dos) horas de ocurrido el siniestro y la misma deberá estar contenida en una base de datos que se encuentre en la República Oriental del Uruguay.
Artículo 11. A los efectos de ejercer la opción por el régimen de Monotributo a que refiere el artículo 18 de la Ley N° 20.396, de 13 de febrero de 2025 deberán cumplirse las condiciones dispuestas por el artículo 71 de la Ley N° 18.083, de 27 de diciembre de 2006 y el Decreto N° 199/007, de 11 de junio de 2007 y sus normas modificativas y concordantes.
ENGLISH TRANSLATION
Article 10. The obligation established for employers under Article 58 of Law No. 16,074 of 10 October 1989 shall be understood to include all information held by the digital platform company regarding the occupational accident that occurred, such as data on working time, log-in, breaks, order acceptance, GPS, and any other information related to the occupational accident or occupational disease suffered by the worker. The digital platform company shall provide such information to the State Insurance Bank within no more than 72 (seventy-two) hours of the occurrence of the accident, and such information shall be contained in a database located in the Oriental Republic of Uruguay.
Article 11. For the purposes of exercising the option for the Monotax regime referred to in Article 18 of Law No. 20,396 of 13 February 2025, the conditions set out in Article 71 of Law No. 18,083 of 27 December 2006 and Decree No. 199/007 of 11 June 2007, as well as their amending and concordant provisions, must be fulfilled. -
Artículo 6. No se considerará tiempo de trabajo aquel durante el cual el trabajador, aun estando logueado, se encuentre en modo pausa, conforme esté previsto en la plataforma. Los tiempos calificados como modo pausa solo se podrán computar como tales una vez finalizada la jornada legal o convencional de trabajo.
Artículo 8. (Límite semanal de trabajo). El trabajador dependiente no podrá prestar tareas que superen las 48 (cuarenta y ocho) horas semanales en una misma empresa titular de plataformas digitales.

Article 6. Time during which the worker, even if logged in, is in pause mode as provided for in the platform shall not be considered working time. Periods classified as pause mode may only be recorded as such once the legal or conventional working day has ended.
Article 8. (Weekly working time limit). A dependent worker may not perform tasks exceeding forty-eight (48) hours per week in the same digital platform company. -
Artículo 7. La retribución del trabajador podrá ser fijada por tiempo de trabajo, producción o destajo. En ese último caso, será acordada por viaje, envío, entrega o distribución, considerando la distancia, el tiempo de desplazamiento y el lapso de espera. Esta retribución se devengará aun cuando el viaje, envío, entrega o distribución no se haga efectivo por causas imputables al cliente o proveedor. En el caso de que la retribución sea acordada por hora, se reconoce a condición de que, por cada hora de trabajo, el trabajador acepta al menos un encargo y no deja de ofrecer sus servicios durante dicho lapso temporal. En cada caso, por cada destajo u hora de trabajo, el trabajador tendrá derecho a percibir, en proporción, el valor del salario mínimo nacional (Decreto-Ley N° 14.791, de 8 de junio de 1978) sin perjuicio de la fijación de salarios mínimos y demás competencias dispuestas por la Ley N° 10.449, de 12 de noviembre de 1943 y su modificativa N° 18.566, de 11 de setiembre de 2009. Las empresas únicamente podrán realizar a los trabajadores dependientes aquellos descuentos o retenciones salariales habilitados por la Ley N° 17.829, de 18 de setiembre de 2004. Están prohibidos los descuentos salariales vinculados a los riesgos propios de la actividad.

Article 7. The remuneration of the worker may be determined by working time, production, or piecework. In the latter case, it shall be agreed per trip, shipment, delivery, or distribution, taking into account the distance, travel time, and waiting period. Such remuneration shall accrue even when the trip, shipment, delivery, or distribution is not effectively carried out for reasons attributable to the client or supplier. Where remuneration is agreed on an hourly basis, it shall be recognised on the condition that, for each hour of work, the worker accepts at least one assignment and does not cease to offer their services during that period. In each case, for each piecework or hour of work, the worker shall be entitled to receive, proportionally, the value of the national minimum wage (Decree-Law No. 14,791 of 8 June 1978), without prejudice to the establishment of minimum wages and other powers set out in Law No. 10,449 of 12 November 1943 and its amending Law No. 18,566 of 11 September 2009. Companies may only make from dependent workers those wage deductions or withholdings authorised by Law No. 17,829 of 18 September 2004. Wage deductions linked to the inherent risks of the activity are prohibited. -

La evaluación de los riesgos de los sistemas automatizados de seguimiento y toma de decisiones para la seguridad y la salud de los trabajadores, en particular en lo que respecta a los posibles riesgos de accidentes laborales, psicosociales y ergonómicos, la evaluación de salvaguardas y la introducción de medidas preventivas y de protección adecuadas se efectuarán de conformidad con lo dispuesto en el Decreto N° 127/014, de 13 de mayo de 2014 en lo pertinente.

Article 4. The assessment of risks arising from automated monitoring and decision-making systems for the safety and health of workers, particularly regarding potential occupational, psychosocial, and ergonomic risks, as well as the evaluation of safeguards and the introduction of appropriate preventive and protective measures, shall be carried out in accordance with the relevant provisions of Decree No. 127/014 of 13 May 2014. -
Artículo 4. La evaluación de los riesgos de los sistemas automatizados de seguimiento y toma de decisiones para la seguridad y la salud de los trabajadores, en particular en lo que respecta a los posibles riesgos de accidentes laborales, psicosociales y ergonómicos, la evaluación de salvaguardas y la introducción de medidas preventivas y de protección adecuadas se efectuarán de conformidad con lo dispuesto en el Decreto N° 127/014, de 13 de mayo de 2014 en lo pertinente.
Artículo 5. Las empresas titulares de plataformas digitales que faciliten servicios de entrega o reparto de mercancías deberán contar con locales adecuados para cumplir con las obligaciones de bienestar según lo dispuesto en el artículo 11 ° de la Ley que se reglamenta. Dichos locales tendrán previstas áreas destinadas a servicios higiénicos, resguardo personal y alimentación para uso de quienes presten tareas de reparto o transporte de manera dependiente o autónoma, sin perjuicio de los acuerdos arribados entre las partes que configuren alternativas más beneficiosas para el trabajador, todo de conformidad con lo dispuesto en el Decreto N° 406/988, de 3 de junio de 1988. Los locales tendrán asimismo espacios adecuados para el estacionamiento de los vehículos empleados para el trabajo, cuando correspondiere.

Article 4. The assessment of risks arising from automated monitoring and decision-making systems for the safety and health of workers, particularly with regard to potential occupational, psychosocial, and ergonomic risks, as well as the evaluation of safeguards and the introduction of appropriate preventive and protective measures, shall be carried out in accordance with the relevant provisions of Decree No. 127/014 of 13 May 2014.
Article 5. Digital platform companies that provide delivery or distribution services of goods shall have suitable facilities to comply with welfare obligations as provided in Article 11 of the law being regulated. Such facilities shall include areas designated for sanitary services, personal shelter, and food for the use of those performing delivery or transport tasks, whether as dependent or self-employed workers, without prejudice to agreements reached between the parties that provide more favourable alternatives for the worker, all in accordance with the provisions of Decree No. 406/988 of 3 June 1988. The facilities shall also include suitable spaces for parking the vehicles used for the work, where applicable.

Artículo 2. La prestación de trabajo en empresas que utilicen plataformas digitales podrá realizarse mediante relaciones contractuales de carácter dependiente o autónomo. Para la efectiva determinación de la calificación jurídica del vínculo contractual se tendrán en cuenta los hechos relativos a la ejecución del trabajo y la remuneración del trabajador, sin perjuicio de la manera en que se caracterice la relación en cualquier arreglo contrario, ya sea de carácter contractual o de otra naturaleza, convenido por las partes. En caso de controversia, se considerarán especialmente los indicios establecidos en la cláusula decimotercera de la Recomendación sobre la relación de trabajo N°198 de la Organización Internacional del Trabajo.
ENGLISH TRANSLATION
Article 2. The provision of work in companies using digital platforms may be carried out through contractual relationships of either dependent or self-employed nature. For the effective determination of the legal qualification of the contractual relationship, the facts relating to the performance of the work and the remuneration of the worker shall be taken into account, notwithstanding the manner in which the relationship is characterised in any contrary arrangement, whether contractual or of another nature, agreed upon by the parties. In case of dispute, particular consideration shall be given to the indicators established in Clause Thirteen of the Employment Relationship Recommendation No. 198 of the International Labour Organization.
