Inclusion of Digital Platform Couriers in the Basque Hospitality Sectoral Agreement

Workers are formally integrated under the hospitality sector agreement, reflecting their status as employees rather than self-employed individuals.

No platform-specific provisions were found regarding deactivation. As employees, any suspension or termination must comply with Spanish labour law, including justified cause and due process.

The hospitality sector agreement includes non-discrimination provisions applicable to riders, covering protected grounds such as gender, age, race, and other recognised categories.

Riders are covered by collective bargaining and enjoy full rights to organise, join unions, and participate in union activities without discrimination or retaliation.

Riders benefit from the occupational safety and health standards set out in the hospitality sector agreement, including training, equipment requirements, and preventive measures applicable to delivery activities.

Full-time riders are entitled to an annual salary ranging from €18,700 to €21,500, in line with the salary scales established under the hospitality sector agreement.

As recognised employees, riders are covered by the standard Spanish social security system, which includes health insurance, unemployment benefits, and pension entitlements.

The agreement stipulates that riders have the same annual working hours as other hospitality workers - between 1,723 and 1,750 hours - consistent with regulated standards for full-time employment.
